Common Medical Provider Errors

Medical malpractice occurs when a medical provider needlessly injures a patient. Typical medical malpractice errors include:

  • Diagnostic errors – Medical providers must accurately and timely identify their patients’ health problems. Also, they must explain their diagnoses to their patients.
  • Treatment errors – Medical providers must safely perform surgeries and tests.
  • Aftercare errors – Doctors must closely monitor post-operative patients to minimize infection risks.
  • Health management errors – One of the leading causes of medical errors is a communication breakdown between medical providers.

If your medical provider injured you, you should contact our Atlanta medical malpractice lawyers. We’ll evaluate your potential claim as soon as we have all of your medical records.

How To Prove A Medical Malpractice Claim

Successful medical malpractice claims demonstrate the following three facts:

  • Provider error – The medical provider breached the applicable standard of care. You must obtain a sworn statement from a relevant medical expert to prove that breach. We’ll help you find the right expert for your case.
  • Injury – The medical provider’s carelessness injured you. You typically need a causation expert to link the misconduct to your injury. We’ll help you find a causation expert, as well.
  • Damages – You suffered damages. Damages include pain and suffering, medical bills, and lost income.

Many patients suffer bad outcomes that aren’t actionable. For instance, if your injury was a “known risk” of the procedure, your claim may fail. Also, a physician may make a mistake that didn’t cause a specific bad outcome. If you’re unsure whether the doctor caused your injury, you should call our injury lawyers.

We’re glad to chat with you even if your injury isn’t covered by one of those categories. It may be a case we can handle. Just give us a call.

Medical Malpractice Claim Filing Deadline

There is a two-year deadline (statute of limitations) to file Georgia medical malpractice claims. The Georgia statute of limitations (SOL) usually doesn’t begin to run until the victim “discovers” that they have a legal claim. Indeed, many medical malpractice victims don’t discover their injuries until several months after the physician’s error occurred.

However, medical malpractice victims don’t have an unlimited amount of time to file their claims. They must file their claims no later than five years after the malpractice incident, regardless of when they discovered their injury. If the medical malpractice victim doesn’t file their lawsuit before the SOL expires, they’re out of luck.

There are some exceptions to Georgia’s medical malpractice SOL. For instance, if you requested your medical records and your medical provider refused to produce them, the SOL is tolled until you receive the records.

However, most SOL exceptions are often difficult to prove. Therefore, you should always try to file your medical malpractice lawsuit long before the SOL expires.
